1. Program Overview
The Max International AutoShip Program (“AutoShip”) is an automatic product delivery service that allows customers buying Max products for personal use as well as Max Associates who act as commissioned resellers of Max International products to receive selected Max International products on a recurring monthly or quarterly basis. By subscribing in this program, you authorize Max International to automatically bill your payment method on file and ship your chosen products to the shipping address on file according to your selected schedule. We refer to your receiving products under the AutoShip Program as your “AutoShip.”
2. Eligibility
To participate in the AutoShip Program, you must be at least 18 years old or have the consent of a parent or legal guardian if you are between 13 and 18 years old, where allowed by law. The AutoShip Program is not available to individuals under the age of 13.
3. Billing & Shipping
AutoShips will be billed and shipped based on your selected date each month. Billing occurs on the date chosen during setup and charges the payment method on file. You are responsible for keeping your billing and shipping information current.
4. Managing Your AutoShip
You can manage your AutoShip settings—including pausing, product changes, billing updates, or cancellation—by logging into account with us at www.gomaxhealth.com.

5. Failed Payments
If your payment method is declined, you will be notified via email. If a valid payment method is not provided within seven (7) days of notification, your AutoShip may be suspended or cancelled at Max International’s discretion.
6. Product Availability
If a product you have ordered as part of your AutoShip is out of stock, you may be notified and offered a substitution or the option to place the item on backorder. Max International reserves the right to change product availability at any time.
7. Pricing and Promotions
AutoShips may include exclusive discounts. All prices are subject to change. You will be notified in advance of any price increases. If you do not agree to the new pricing, you may cancel your AutoShip of the related product without penalty before the new price takes effect.
8. AutoShip Cancellation
You may cancel your AutoShip at any time.
9. Refunds & Return Policy
Returns and refunds for AutoShip orders are subject to Max International’s standard Return/Refund Policy. For details, please refer to the Refunds & Return Policy or contact Customer Service. Products must be returned in accordance with the instructions provided to be eligible for a refund.
10. Electronic Communications
By enrolling in the AutoShip Program, you consent to receive communications from Max International electronically, including emails, account notifications, and updates regarding your AutoShip. These communications satisfy any legal requirement that such communications be in writing. You are responsible for maintaining a valid email address in your account profile.
11. Privacy Policy
Your participation in the AutoShip Program is subject to Max International’s Privacy Policy, which describes how your personal information is collected, used, and protected. By enrolling, you acknowledge and agree to the terms of the Privacy Policy.
12. Governing Law, Dispute Resolution and Arbitration
These Terms & Conditions are governed by the laws of the State of Utah, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms & Conditions shall be resolved by binding individual arbitration, rather than in a court of law, except as otherwise required by applicable law. The arbitration will be conducted in accordance with the rules of the American Arbitration Association and will be held in the jurisdiction in which Max International maintains its headquarters. To the extent permitted under the relevant arbitration rules, the parties and their counsel will be permitted to participate via telephone or other means of remote communication. Any arbitration conducted pursuant to this Section will be subject to the waivers contained in Section 13 below. If you wish to opt out of this arbitration agreement, you must notify Max International in writing within 30 days of enrolling in the AutoShip Program.
13. JURY TRIAL AND CLASS ACTION WAIVERS
IN CONNECTION WITH ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THE AutoShip PROGRAM AND/OR THESE TERMS & CONDITIONS (A “DISPUTE”), YOU AND MAX INTERNATIONAL EACH WAIVE THE RIGHT TO A TRIAL BY JURY, WHETHER IN A COURT OF LAW OR IN ARBITRATION.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY FURTHER WAIVE, WITH RESPECT TO ANY DISPUTE: (I) THE RIGHT TO PARTICIPATE IN A CLASS ACTION, PRIVATE ATTORNEY GENERAL ACTION OR OTHER REPRESENTATIVE ACTION, WHETHER IN COURT OR IN ARBITRATION, EITHER AS A CLASS REPRESENTATIVE OR CLASS MEMBER; AND (II) THE RIGHT TO JOIN OR CONSOLIDATE CLAIMS WITH CLAIMS OF ANY OTHER PERSON.
14. Limitation of Liability
In connection with any Dispute, Max International is not liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including damages for lost profits or revenues, arising from your participation in the AutoShip Program, including but not limited to delays, product unavailability, or changes in pricing. By participating in the AutoShip Program, you hereby agree that, to the fullest extent permitted by law, Max International’s liability arising in connection with the AutoShip Program and/or these Terms & Conditions shall be limited to and shall not exceed the amount paid by you to Max International under the AutoShip Program in the 12-month period immediately preceding the event giving rise to the first Dispute for which damages or other compensation or reimbursements are sought.
15. Changes to Terms
We may update these Terms & Conditions from time to time by posting the revised version on Max International’s sales website. Changes take effect immediately upon posting. Your continued participation in the AutoShip Program after such changes constitutes your acceptance of the revised terms.
16. Explicit Consent
By enrolling in the Max International AutoShip Program, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, as well as Max International’s Privacy Policy and Return Policy. If you do not agree to these terms, do not enroll in or use the AutoShip Program.
